These Terms of Use and Terms of Sale (“Terms”) govern your access to and use of our websites, products, services, and online community.

By accessing or using the Site, purchasing products, registering for events, or participating in our online community, you agree to these Terms. If you do not agree, do not use the Site or purchase from us.
PART A: TERMS OF USE
1. Acceptance of Terms
These Terms of Use are a legally binding agreement between you and the Company. By using the Site, you accept and agree to be bound by these Terms and any documents incorporated by reference, including our Privacy Policy and Terms of Sale.
2. Changes to the Terms
We may revise these Terms at any time in our sole discretion. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
3. Accessing the Site and Account Security
We may withdraw, amend, suspend, or restrict all or any portion of the Site without notice. We are not liable if the Site is unavailable for any reason.
If you create an account or access paid areas:
- You must provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify us immediately of any unauthorized access or use.
We may disable any account or credentials at any time if we believe you violated these Terms.
4. Intellectual Property Rights
The Site and its entire contents (including text, graphics, images, videos, downloads, templates, curriculum, journal/planner content, branding, and design) are owned by the Company or its licensors and protected by intellectual property laws.
You may use the Site for personal, non-commercial use only unless we provide written permission. You may not reproduce, distribute, modify, sell, license, create derivative works, or exploit any materials without our prior written consent.

5. Trademarks
Take Up Space™, Jarvis Noelle LLC, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You may not use our trademarks without prior written permission.
6. Prohibited Uses
You agree not to use the Site:
- In violation of any law or regulation
- To exploit, harm, or attempt to harm minors
- To send spam, solicitations, or unauthorized advertising
- To impersonate the Company or others
- To interfere with Site functionality or security (including using bots, scraping, hacking, or introducing malware)
7. User Contributions and Community Conduct
The Site may offer interactive features including comments, groups, forums, community spaces, live chats, or submissions (“Interactive Services”).
If you post or submit content (“User Contributions”):
- You represent you own or control rights to the content you share.
- Your content must comply with these Terms and applicable laws.
- You grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt your User Contributions for operating and promoting the Site and services.
We may remove content, restrict access, or terminate accounts for any reason, including violation of these Terms.
8. Content Standards
User Contributions must not:
- Be defamatory, obscene, abusive, harassing, hateful, or discriminatory
- Promote illegal activity
- Infringe intellectual property or privacy rights
- Mislead, impersonate, or misrepresent affiliation
- Include unauthorized commercial promotions, contests, or solicitations
9. Reliance on Information / Educational Disclaimer
Content on the Site is provided for general educational and informational purposes. We do not guarantee results. You are responsible for your own decisions and outcomes.
10. Links to Third Parties
We may link to third-party sites. We are not responsible for third-party content or practices. Access third-party links at your own risk.
11. Geographic Restrictions
The Site is operated from the United States. We make no representations that the Site is accessible or appropriate outside the U.S.
12. Disclaimer of Warranties
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PURCHASE/USE OF PRODUCTS OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless the Company from any claims arising from your violation of these Terms, misuse of the Site, or infringement of rights.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Unless arbitration is required (see below), any legal action must be brought in state or federal courts located in Harris County, Texas, and you consent to jurisdiction and venue there.
16. Arbitration (Optional but Included Here)
At the Company’s sole discretion, we may require disputes to be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.
Class action waiver: Arbitration will be conducted on an individual basis. You and the Company waive any right to participate in a class action or representative proceeding.
17. Limitation on Time to File Claims
Any claim arising from these Terms must be brought within one (1) year after the claim accrues, unless prohibited by law.
18. Severability and Waiver
If any provision is found unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver.
19. Entire Agreement
These Terms, along with our Privacy Policy and Terms of Sale, form the entire agreement between you and the Company regarding the Site and offerings.

PART B: TERMS OF SALE
IMPORTANT: These Terms of Sale apply to purchases of:
- Physical products (journals, planners, stationery, merchandise)
- Digital products (downloads, templates, recordings, replays)
- Events (virtual or in-person; free or paid)
- Subscriptions and memberships (online community access, paid groups, etc.)
- Services (if offered)
By placing an order, you affirm you are of legal age and agree to these Terms.
1. Orders; Acceptance; Cancellations
Your order is an offer to purchase. We may accept or decline orders at our discretion. If we cancel an order after payment, we will issue a refund for the canceled item(s).
2. Pricing; Payment; Errors
Prices are subject to change without notice. The price charged is the price at checkout. We may correct errors in pricing, descriptions, or availability and cancel affected orders.
You agree to provide current, complete payment information and authorize us (and our payment processors) to charge your payment method.
3. Taxes and Shipping
Prices do not include taxes or shipping unless stated. Shipping charges and estimated delivery timing will be shown at checkout or on the product page.
4. Shipping; Delivery; Risk of Loss
We currently ship only within the United States. We do not offer international shipping at this time.
Shipping and handling charges will be displayed at checkout. Delivery dates are estimates only and are not guaranteed. Title and risk of loss pass to you when the products are transferred to the carrier.
We are not responsible for delays caused by carriers, weather conditions, supply chain disruptions, or other circumstances beyond our reasonable control.
5. Returns, Refunds, and Exchanges
All sales are final. We do not accept returns or exchanges.

Physical products:
If your order arrives damaged, you must contact us within 7 days of delivery by emailing support@takeupspacecollective.com. Please include: - Your order number
- Clear photos of the damaged item
- Photos of the original packaging
Failure to notify us within this 7-day window may result in the claim being denied.

Digital products:
Due to the nature of digital content and instant access, all digital sales are final and non-refundable. -
Events, memberships, and online community access:
Unless otherwise stated at checkout, all sales are final once access is granted or the event date has passed.
6. Use Restrictions; No Resale
All products and services sold through the Site are intended for personal, non-commercial use only. You may not resell, export, sublicense, distribute, or commercially exploit any physical products, digital products, event materials, or community content without prior written permission from the Company.
7. Community Rules and Termination
If you participate in our online community, you agree to respectful conduct. We may suspend or terminate access for violations of community guidelines or these Terms without refund.
8. Disclaimers for Products/Services
Our products and services support planning, reflection, and personal development. They do not provide medical, legal, psychological, or financial advice. You are responsible for your own decisions and outcomes.
9. Privacy
Purchases are subject to our Privacy Policy.
10. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, carrier disruptions, supply chain delays, power outages).
11. Governing Law; Venue; Arbitration
These Terms of Sale are governed by Texas law. Disputes may be subject to arbitration at our sole discretion as described in the Terms of Use. Venue (if applicable) is Harris County, Texas.
